State of Texas Marriage License Requirements
- Marriage Licenses are available from any County Clerk’s Office in Texas; valid for a marriage ceremony anywhere in Texas.
- Complete application online before going to the County Clerk’s Office. License is issued in person by the County Clerk.
- Generally, both applicants must appear in person to obtain the license. Exceptions may apply—check with the County Clerk’s Office.
- Each applicant must present valid identification showing identity and age.
- Acceptable ID includes:
- Valid Driver’s License
- State-issued ID
- U.S. or Foreign Passport
- Military ID
- Social Security number required, if applicable. Social Security card not required.
- Questions about other forms of ID? Check with the County Clerk’s Office.
- Both applicants must generally be 18 years of age or older.
- Under 18? Parental consent alone is not sufficient. Special court requirements apply—check with the County Clerk’s Office.
- 72-hour waiting period after Marriage License is issued before ceremony can take place.
- Waiting period may be waived for:
- Active-duty U.S. military
- Certain U.S. Department of Defense personnel
- Couples completing an approved premarital education course
- Court-approved waiver
- Marriage License fee: approximately $71–$88, depending on county.

- Witnesses are not required in Texas.
- After the ceremony, the Officiant completes and signs the Marriage License.
- Officiant is responsible for ensuring the completed license is returned to the County Clerk’s Office that issued it within 30 days.
